In 2004, I was still in college. How can a case be open that long? It takes 6 years for it to go to trial? Was the CHARGE dropped? If it was dropped or dismissed by the court, Matt can have it expunged within a certain time period so that it doesnt appear on his criminal history. Anytime someone is arrested or charged, it appears on your criminal history regardless of whether it was dropped, dismissed, or you were proven innocent. In order to have an arrest or charge removed from your criminal history, you have to hire an attorney for it to be expunged meaning REMOVED PERMENANTLY and after the removal you can legally deny the charge ever existed for the rest of your life. They leave dropped or dismissed charges on a criminal history so just in case a person repeats a crime. In court, if the crime is repeated and they see you have a criminal history with the same or worse, it gives the court justification to convict you or at least give them solid evidence that you’ve had a history of a crime. That is why there is a statue of limitation. However, most truely innocent people are good during this statue of limitation and thus get the information expunged and never commit, get arrested, or charged with any other crime for the rest of their lives because it scares them to death. So I hope that helps…answer a lot of questions as to what his case may mean.

The only time you get in trouble for doing something with a 17 year old is if you videotape them or take photos of them then promote those photos or videotape . 17 IS considered a minor when it comes to film and/or photography…only!

The age of consent is 17 in Texas but they will apply the 3 year rule to weed out cases of parents not liking who their kid is dating. An outcry can be made at anytime because the human brain can suppress our emotions when something traumatic happens. You can be 35 and remember something that happened when you were 3. But also remember, just because a case is brought before the grang jury, does not make the person guilty. That is up to a trial court and a jury of his peers to decide basedon the evidence presented.
