The other statements appear valid but I think it kind of falls flat on this point as you clearly have made the pictures themselves the story thereby making the PHOTOs the story and thus no longer an “incidental” par tof a “news story”

#1: Bimbo’s attorney want name of source for photos. Answer NO. Read first amendment of the Constitution. Then read McIntyre v. Ohio Elections Commission. Issue resolved.
#2: Bimbo’s attorney want photos taken down. Answer NO. Reasons are:
a) Bimbo gave up rights to control name and image by entering the contest and the public debate. She has also entered the political arena through anti-gay org’s she signed on with.
b) Bimbo age at the time of the photos are irrelevant. They were NON pornographic (pornography is defined by us, yes we do have a definition, and a three pronged test). See Stanley v. General Media Comm for additional info.
c) Bimbo can’t claim “emotional distress.” As we stated in Hustler vs Falwell, “public figures may not recover for tort of intentional infliction of emotional distress by reason of publication” UNLESS it was concurrently published with a false statement of fact, which was made with “ACTUAL MALICE.”
Given the above, I find that Bimbo has no case, and throw her out.
