      There is no “compensation” for this family that will make this situation any easier for them. I represent families who have lost loved ones in tragic accidents, and there is no amount of money in the world that will make this better. What must be done, is that Hard Rock must be held accountable and responsible for their actions, so this doesn’t happen again. My understanding is that the hotel was way understaffed, and that lifeguards weren’t present. The compensation that this family can get is that HardRock is held responsible and accountable for not providing a safe environment for their guests.

The man had water in his ocular cavity, he was under water for such a long time. It is Rehab, how many people were in the pool that “ignored” him? Surely someone could have helped him, but instead they were too busy poppin pills and guzzling gallons of over-priced boozes. And why was there only 1 lifeguard for all of those hundreds of people?

        A wrongful death claim generally consists of four elements: (1) the death was caused, in whole or part, by the conduct of the defendant (2) the defendant was negligent or strictly liable for the victim’s death; (3) there is a surviving spouse, children, beneficiaries or dependents; and (4) monetary damages have resulted from the victim’s death.

        If the victim’s family (3 – surviving beneficiaries) can prove that management turned a blind eye (1 – conduct of defendant) on excessive alcohol abuse and/or drug use on the premises, or refused to implement safeguards (2 – negligence of defendant) against these activities, management can be held partially responsible for the victim’s death. If the man had dependents – such as a stay at home wife who depended on his salary to survive – management can be held responsible to pay x amount of money to make up for the lost wages of the victim (4 – monetary damages).

        Don’t blame me; blame trial lawyers!

    FYI it isnt in the hands of the GM, the insurance company will send out some “value of life” adjusters & lawers to figure out how little they can pay. Due to the fact that alcohol, possibly drugs were involved it wont be that much. They are also going to have to prove that they (the bar) were negligent, which will be very hard. I would bet that they settle for $250K….the family walks away with $175K. Sad situation.

I feel horrible for his family but sometimes people come to Vegas to let loose and they tend to go to far sometimes. Me being a cocktail waitress for this craZy pool it was just an unfortunate event but you can’t put blame on other people( even though it is easier to do so.)

    i was there yesterday and i seen it all happen as they pulled this poor man out. all i know is getting into rehab via security check points was difficult. i almost felt as if i was meeting president obama. between pat downs, police officers and security patrolling the entire day, they did everything possible to prevent any type of disturbance. unfortunately, we do not know the circumstances regarding the reasoning for his death. do not blame the hard rock staff for this unfortunate incident

On Memorial Day weekend, a small bottle of Fiji at Wet Republic cost $10.00 up from the regular price of 5 or 7 bucks. You already know people are going to be drugging it up out there, fcking give the druggies some fcking water at better prices. I understand it’s a money making gimmick, but seriously, these motherfkers suck! Some countries have laws that bottled water cannot exceed a certain price since they have extremely hot temps.

The biggest travesty was the care he received by the staff EMT’s after he was pulled out. They didn’t even know to place an airway and start giving him oxygen. It’s a sad, sad thing, unfortunately people need to take personal responsibility for their actions, and none of us know how drunk he was or if he was under the influence of any drugs. Those two combined with heat are killers. I pray for his family and friends because regardless of how you look at this, they lost a son and friend

      My friends and I were next to the EMT’s that helped him. They reacted faster than the staff and seemed to be more prepared. Even more absurd was the dumb girls who tried to walk through the whole thing to get back in the scuzzy pool. People making assumptions about what happened to this person are just trying to get attention and a reaction. If you saw what happened and how obviously injured he was you would keep judgemental comments to yourselves. His friends and family are mourning him be respectful.

    My friend works at Rehab every summer, She said that she knew this was gonna happen eventually. She said there are sooo many people sent to the Hospital every summer for injuries, Heat exhaustion, dehydration, fights ect, She said managment said Vegas is gonna have to get soooo much insurance pretty soon just for all the pool parties in all the hotels now. That these will eventually fade out. Plus there aren’t too many pools for the tourists to relax at anymore and actually swim and lay out. So they have been getting lots of complaints at all the pool party hotels. Good thing she’s a school teacher in the winter. Blessings to that mans family. It’s awful.

    The new president brought AMG in to clean up the pool and all that has happened is they are losing money as compared to last year and now someone has died
