A 22-year-old woman, who was the key player in a scheme that siphoned a quarter of a million dollars out of the accounts of an 86-year-old Kings -ton man almost four years ago, has finally been called to account.
Mikyla Miller, who was only 18 and had no criminal record when she and two housemates became involved in the scam in May 2006, was given a conditional sentence of two-years-less-one-day to serve in the community, the first 20 months under house arrest.
She was also made subject to a standalone restitution order for $75,000.
In sentencing Miller, Justice Helen MacLeod-Beliveau noted that the crime was “highly egregious,” and told the young woman: “it is a sad day when we have people in our community preying on seniors.”
Given the nature of the crime, Miller’s circumstance and the sentence range contemplated, the judge was required to consider community sentencing. She said, it was “with great reluctance,” however, that she found Miller “met the parameters and prerequisites” to receive one.
In his victim impact statement, one of the victim’s sons disclosed to the court that his family had hoped their father would be able to remain in his condominium and that his savings would pay for the assistance and care he required to do that.
But Miller and her two companions in crime siphoned away so much of the elderly man’s nest egg, the judge was told, his family had to move him to a nursing home not long after the crime was uncovered.
MacLeod-Beliveau said “the fact that (he) cannot be cared for in his own home because of this fraud is heart-wrenching.”
Miller’s two co-accused, Mandy Susan Snyder and Michael Cumpson, who are both now 23, were convicted last year for their part in the elderly man’s exploitation. Both pleaded guilty to a single count each of possessing property obtained by crime and received 15-month conditional sentences with house arrest.
Only Miller, who held out the longest, pleaded guilty to the actual fraud.
Assistant Crown attorney Priscilla Christie characterized her as “the ring leader in this case,” observing that though “the others profited … it was Mikyla Miller who approached (the victim).”
MacLeod-Beliveau was told that the Miller and her co-accused first became aware of the victim as the owner of rental properties in the city and an easy touch for a hard luck story.
It all began around May 2006, according to the prosecutor, after an alleged break-in at an apartment Miller shared with Snyder.
The victim owned the apartment building and Christie said Miller was somehow able to convince him to give her $2,500 for furniture she claimed had been smashed by burglars.
The judge was told she take advantage of his failing memory and generosity in equal measure over a period of about 10 months.
Miller has since married and recently had a baby, according to her lawyer, Mike Woogh. Four years ago, she was childless, but she convinced her victim she was a struggling single mother with two small children and the victim gave her money to buy food.
Another time, she talked him into giving her $4,000 for tuition to Queen’s University, which she never attended.
She even put the touch on him with lies about a sick child, claiming she needed cash for brain surgery.
Finally, Christie said, she used extortion, threatening to tell people that the victim had behaved sexually inappropriately toward her.
The scam was finally uncovered in February 2007, however, after Miller accompanied the victim to his bank and raised the suspicions of a bank employee. A subsequent examination of the man’s accounts revealed the extent to which they were being looted. The bank notified police, who later seized a frivolous assortment of things the trio had bought with the old man’s money, including six used vehicles, one of which was painted pink after being bought for $5,000.
There was also an ATV, bundles of clothes, furniture, a big-screen TV, electronics, games, a new washer and dryer, even a diamond engagement ring.
All of those items have been in storage while charges remained outstanding against Miller.
Following her sentencing, Christie requested an order of forfeiture of the entire inventory to the Crown.
She told the judge that the victim’s son may be able to petition the government for the return of at least a portion of the proceeds from the sale of those items to his father’s estate. She disclosed, however, that there’s no mechanism in the Criminal Code for transferring those assets to the victim, his money having been converted and seized as property of crime.
MacLeod-Beliveau noted that the $250,000 Miller and her friends took from their elderly mark “represented a lifetime of work,” and that the victim had once received a “best landlord award.” The judge observed that over the course of the man’s lifetime, he’d helped so many people that she characterized him as “a one-man social service.”
Yet, “after 50 years of scrimping and saving and investing,” she said, “he was brutally taken advantage of.”
The judge said “he was belittled and hurt by a group of selfish youth.”
She said she shuddered to think what might have happened if the man’s banker hadn’t noticed what was happening.
“It didn’t seem to matter that (he) could be left penniless without enough money to buy groceries,” she said, “and for what?”
The judge answered her own question by characterizing the purchases Miller and her friends made as an “outrageous list of junk.”
