The Dirty can exclusively reveal Will Smith is firing back at the $15 million lawsuit filed by a screenwriter – who accused the actor of stealing his idea and turning it into “Blackish” – with the actor saying the man didn’t read the fine print.
Earlier this year, screenwriter David Marcus sued Will Smith, ABC Studios & producer Kenya Barris for $15 million … accusing them of stealing his idea and turning it into the hit show “Blackish”.
Marcus accused Smith and others of fraud. He explained he entered his script into a contest run by the actor back in 2013. His script, “Across The Tracks” was a humorous look at the lives of an upwardly mobile middle class African American family.
He never heard back from the contest but later realized “Blackish” was stolen from his work … with everything from the characters, thematic points and plot turns allegedly nearly identical to his work. The writer sued seeking $15 million dollars along with an injunction against Blackish from continuing to be aired unless he is listed as the creator on the credits.
Then on March 17th, Will Smith fired back at the unknown writer demanding the $15 million suit be thrown out of court.
Smith denies all allegations of wrongdoing and points out that the man should have looked at the contest rules … the actor never addresses if Marcus’ work was used as a basis for “Blackish” but he says he did nothing wrong. He is demanding the entire lawsuit be thrown out.
