EXCLUSIVE: Kesha – Judge Shuts Down Singer in Dr. Luke Legal Battle, Says She Signed a Record Deal with Music Producer Years after Alleged Abuse Began
The Dirty can exclusively reveal Kesha has been shut down by a New York judge in her legal battle with Dr. Luke … with the judge blasting the singer for demanding her record deal be terminated … saying she signed a deal with the producer 3 years after she claims the alleged abuse began.
Recently, Kesha filed a motion to amend her counterclaims against Dr. Luke … seeking to add a claim that would terminate her contract with Luke following the release of her upcoming third album. She pleaded with the judge to allow her to add the new claims to her suit against the producer … pointing out it’s impossible to continue to work with her alleged abuser.
Then on March 21st, the judge came back with his decision and shut Kesha down in the legal battle. He points out that Luke has provided evidence that Kesha owes his company $1.3 million in royalties … which she has not rebutted. He notes she has failed to pay Luke his cut since 2012.
The judge says Kesha cannot establish that she performed her obligations under the deal, when she failed to hold up her end.
In regards to terminating her record deal after the release of the third album … he finds that hard to believe due to the singer admitting in a sworn affidavit that the abuse began in 2005 but she signed a deal with Luke in 2008. The judge says Kesha’s argument that the verbal abuse and physical threats were not foreseeable doesn’t match with the facts.
The judge denied her motion to amend her complaint.
